1. Definitions
- "Guardianship" — A symbolic, commemorative connection between a Guardian and the Migdal archaeological site in Israel
- "Guardian" — An individual who makes a charitable donation and receives a Certificate of Guardianship
- "Unique Identifier" — The alphanumeric code (format MIG-X-XXXXX) assigned to each Guardianship
- "Registry" — The public, permanent database of all Guardianships at guardiansofmagdala.org
- "We", "Us", "Our" — Migdal Heritage Kenya Ltd., the issuing organisation
2. Nature of Guardianship
A Migdal Symbolic Guardianship is a commemorative, symbolic connection — not a legal property right. Specifically:
- Guardianship does not convey legal title, ownership, or any real property rights under Israeli law or any other jurisdiction
- Guardianship does not grant any right to occupy, develop, visit, or use the land
- Guardianship is not a timeshare, fractional ownership, or investment product
- Guardianship does not create a legal trust or fiduciary relationship
- The unique identifier is not a legal deed, plot number, or cadastral reference
Guardianship is a spiritual, commemorative connection supported by a charitable donation. Your name in the Registry symbolises your commitment to protecting sacred ground.
3. Charitable Donations
Your payment is a charitable donation to support:
- Land stewardship and archaeological preservation at Migdal
- Certificate fulfilment (printing, postage, handling)
- The charitable mission of Migdal Heritage Kenya Ltd.
Donations start at USD $50 (or KSh 7,000 for Kenya). Prices are set by the issuing organisation and may be updated from time to time. The price in effect at the time of your donation applies.
Donations are generally non-refundable, as they are charitable contributions. Exceptions: duplicate charges will be refunded in full. Name corrections within 30 days of issue cost $5.00.
4. Certificate of Guardianship
Upon confirmation of your charitable donation, you will receive:
- A physical Certificate of Guardianship printed on premium paper stock
- Your full name and unique identifier on the certificate
- The official seal of Guardians of Magdala
The certificate is delivered by registered mail to the postal address you provide. Delivery typically takes 14-21 days within Kenya and 21-30 days internationally.
If your certificate is lost or damaged, you may request a reissue for a $5.00 fee. If your certificate contains a spelling error, you may request a correction within 30 days of issue for $5.00.
5. The Public Registry
Your unique identifier and the certificate name you provide will be recorded in the Guardians of Magdala Registry — a public, permanent database accessible at guardiansofmagdala.org/verify.
- Your certificate name and unique identifier are publicly visible
- Your email, phone, postal address, and payment details are never displayed publicly
- The Registry exists so that any person can verify the authenticity of a Certificate of Guardianship
- Registry entries are permanent and cannot be deleted
By making a charitable donation, you consent to having your certificate name and unique identifier published in the Registry.
6. Website Use
By using guardiansofmagdala.org, you agree:
- Not to attempt to access restricted areas without authorisation
- Not to use automated tools to scrape, mine, or extract data from the Registry
- Not to submit false or fraudulent information
- That we may modify or discontinue any part of the website at any time
The website is provided "as is" without warranty of any kind. We are not liable for any damages arising from your use of the website.
7. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Kenya.
